As part of this fundamental obligation, PortaFab is committed to the appropriate protection and use of personal information that we collect or that is provided to us through our websites and other online and mobile services that link to or post this Privacy Policy (collectively, the “Online Services”) as well as personal information that we collect offline or is provided to us offline in connection with the operation of our business and the offering of our products and services (together with the Online Services, our “Services”).

1. Collection and Use of Personal Information
Personal information means information that can directly or indirectly identify you or other individuals. This typically includes information such as your name, address, email address, and telephone number, but, in some instances, can also include other information such as IP address, shopping habits, information about health, information about your lifestyle or preferences such as your hobbies and interests.
We collect your personal information directly when you provide us with personal information so that you can register for a service, receive a quote, information, or mailings, use our applications, buy a product or service from us, complete a survey, make a comment or inquiry or contact our customer services, and apply for employment with us. We may also receive Personal Data about you from other sources, including information from commercially available sources, such as public databases and data aggregators, and information from third parties.
In more detail, we process the following categories of Personal Data for the purposes below. Your personal information is not used for other purposes, unless we obtain your permission, or unless otherwise required or permitted by law or professional standards.
A. REGISTERING FOR A SERVICE
When you register for a Service, we may collect personal information about you such as your name, username, password, email address, physical address, phone number, date of birth, and other personal and business demographic or contact information. Depending on the Services of which you make use, we may also collect commercial information, including credit card information, payment details, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies; internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with our websites, applications, or advertisements; and geolocation data. We collect this information to maintain and provide our Services relating to individual user and customer accounts and our bases for such collection is your consent, and our legitimate interests for internal administrative purposes.
We store this personal information for up to 5 years after you stop interacting with your account, unless we are required by the law to store it for a longer period. In some cases where you have registered for certain services, we may store your email address temporarily until we receive confirmation of the information you provided via an email (i.e., where we send an email to the email address provided as part of your registration to confirm a subscription request).
B. CONTACT WITH YOU, INCLUDING SUGGESTION OF OUR PRODUCTS AND SERVICES WHICH MAY BE OF INTEREST FOR YOU AND MARKETING COMMUNICATION
To contact you, we may collect personal information about you such as your name, email address, physical address, phone number, and other personal and business demographic or contact information For example, if you send us an email message requesting information about PortaFab, we will use your email address and other information you supply to respond to your request. We use this personal information to respond your inquiries and comments and to provide you with our products or Services that you request from us. Our bases for collection of this information is performance of a customer contract with you, or in order to take steps at your request prior to entering into a contract (i.e. fulfill your contact request), and as applicable, your consent.
We store this personal information for up 7 years after you provide it to us, unless we are required by the law to store it for a longer period. If you do not provide this personal information, we may be unable to enter into a customer contract with you.
C. CONDUCTING BUSINESS WITH YOU, INCLUDING PROCESSING, FULFILLING, AND FOLLOWING UP ON ONLINE, TELEPHONE AND IN-PERSON PURCHASES AND CUSTOMER SERVICE REQUESTS
To conduct business with you, we may collect personal information such as name, signature, address, email address, telephone number, bank account number, credit card number, debit card number, or any other financial information. We collect and process this personal information to take and fill orders for products or services, to facilitate delivery or provision thereof, to respond to inquiries with respect to products and services you order, to respond to warranty, refunds or other claims, and to monitor and enhance our logistics operations. Our bases for collection of this information is performance of a customer contract with you, our legitimate interests for internal administrative purposes, and as applicable, your consent.
We store this personal information for up 7 years after you provide it to us, unless we are required by the law to store it for a longer period. If you do not provide this personal information, we may be unable to enter into a customer contract with you.
D. PROCESS JOB APPLICATIONS
You may also provide us with certain personal information in connection with an application for employment with PortaFab, including name, address, email address, telephone number, date of birth, your sex/gender, professional or employment-related information, including work experience, job titles, company names and dates of employment, education and education degree(s) and related information. If you send us a resume or curriculum vitae (CV) to apply online for a position with PortaFab, we will use the information that you provide to match you with available PortaFab job opportunities. We will also use this information to facilitate applications for employment, conduct background checks, complete hiring, administer compensation and benefits, monitor employee performance and to otherwise manage our employment relationship and interaction between employees.
Our bases for collection of this information is our legitimate interests for internal administrative purposes and as applicable, your consent. We store this personal information for up 7 years if your application does not result in employment and we store your personal information permanently if you are hired as a PortaFab employee, unless we are required by the law to store it for a different period.
PortaFab only collects “sensitive” personal information when the relevant individuals voluntarily provide us with this information, or where such information is required or permitted to be collected by law or professional standards. Sensitive information includes personal information regarding a person's race, ethnicity, political beliefs, trade union membership, religious or similar beliefs, physical or mental health, sexual life or criminal record. Please use your discretion when providing sensitive information to PortaFab, and under any circumstances, do not provide sensitive information to PortaFab, unless you thereby consent to PortaFab’s use of that information for its legitimate business purposes and consent to the transfer and storage of such information to and in PortaFab databases. E. USING OUR ONLINE SERVICES
As described more below, in some instances, PortaFab and its service providers use cookies, web beacons and other technologies to automatically collect certain types of information when you use the Online Services. The collection of this information allows us to customize your online experience; improve the performance, usability and effectiveness of our Online Services and PortaFab’s online presence; advertise and market our Services; measure the effectiveness of our marketing activities; and generate and analyze statistics about your use of the Online Services.
For this purpose we may collect the following types of personal information: information about the type of browser you use, details of the web pages you have viewed, your IP and device address, your Cookie ID, application ID or other passive ID information, hyperlinks or application pages that you have clicked, and any other information you choose to share when using Third Party Sites, the websites you visited before arriving at our relevant websites and information collected by cookies or similar tracking devices.
Our bases for the collection of this personal information is your consent, through our Cookie Banner, and our legitimate interests for internal administrative purposes. We store your personal information for up 7 years after you provide it to us, unless we are required by the law to store it for a longer period.
It is always possible for you to visit our Online Services without disclosing your personal information. This requires that you have disabled cookies on your browser. You can opt out of the processing of such information via our Cookie Banner. Please note, however, that without cookies you may not be able to use all of the features of our Online Services.
F. PREVENTION OF HARM TO US, OUR PRODUCTS OR SERVICES OR A PERSON OR PROPERTY (E.G., FRAUD PREVENTION) OR DEFEND OURSELVES AGAINST CLAIMS OR POTENTIAL CLAIMS
For this purpose, we process the following personal information: your first and last names, your address, your email address, your criminal or credit history and relevant information about (i) the harm or potential harm, (ii) the claim or potential claim or (iii) the situation or circumstances giving rise to harm, potential harm, claim or potential claim. We will process this personal information for the purposes of preventing harm to PortaFab, our products or services or to any person or property (e.g., fraud prevention) and/or in the bringing or prosecution of a claim or potential claim against you. In addition, we may process this personal information for the purposes of defending PortaFab against claims or potential claims made against us.
Our basis for processing this personal information (i) a legal obligation to which we are subject or (ii) our legitimate interests in protecting our business, products, services or a person or property or to defend ourselves against claims or potential claims.
We store this personal information for up 7 years after you provide it to us, unless we are required by the law to store it for a longer period or unless we reasonably anticipate litigation with regard to the matter in which case we would retain relevant personal information until such time as the litigation is concluded or is no longer reasonably anticipated.
1.1 Automatic Collection of Personal Information
1.1.1 IP Addresses
An IP address is a number assigned to your computer or internet-enabled device whenever you access the internet. It allows computers and servers to recognize and communicate with one another. IP addresses from which visitors appear to originate may be recorded for IT security and system diagnostic purposes. This information may also be used in aggregate form to maintain and improve the Online Services and to generate and analyze statistics about the Online Services and your use of the Online Services.
1.1.2 Cookies
Cookies may be placed on your computer or internet-enabled device whenever you visit the Online Services. This allows the Online Services to remember your computer or device and serves a number of purposes.
On our Online Services, a Cookie Banner will appear requiring your consent to collect cookies. If you do not provide consent, your computer or internet-enabled device will not be tracked for marketing-related activities. Your selection will be saved in a cookie and is valid for a period of 90 days. If you wish to revoke your selection, you may do so by clearing your browser's cookies.
A secondary type of cookie referred to as "user-input" cookies may still be required for necessary functionality. These cookies are essential for you to browse the Online Services and use its features. Such cookies will not be blocked if you do not consent through the Cookie Banner.
Although most browsers automatically accept cookies, you may be able to choose whether or not to accept cookies via your browser's settings (often found in your browser's Tools or Preferences menu). You may also be able to delete cookies from your device. However, please be aware that if you do not accept cookies, you may not be able to fully experience some of the features of the Online Services.

Other third party tools and widgets may be used on our individual web pages or portions of the Online Services to provide additional functionality. Use of these tools or widgets may place a cookie on your device to make their service easier to use, and ensure your interaction is displayed properly.
1.1.3 Do Not Track
Do Not Track is a privacy preference that users can set in their web browsers. Our Online Services do not recognize browser-based Do Not Track signals. However, as discussed above under “Cookies,” you may be able to modify your browser settings to block all cookies, or to block “third-party” cookies. Cookies that we set on our Online Services are considered “first-party” cookies. Details on your ability to restrict or change the personal information that we may collect about you are listed below under the Choice and Access sections of this policy.
1.1.4 Usage Analytics
PortaFab uses several third party usage analytics tools including Google Analytics. More information about how Google Analytics is used by PortaFab can be found here. By agreeing to the use of cookies on our website through our Cookie Banner, you direct us to disclose your personal information our third-party analytics service providers. To provide website visitors with more choice on how their data is collected by Google Analytics, Google has developed the Google Analytics Opt-out Browser Add-on. The add-on communicates with the Google Analytics JavaScript (ga.js) to indicate that information about the website visit should not be sent to Google Analytics. The Google Analytics Opt-out Browser Add-on does not prevent information from being sent to the Online Services or to other web analytics services.
1.1.5 Web Beacons
A web beacon is a small image file on a web page that can be used to collect certain information from your computer, such as an IP address, the time the content was viewed, a browser type, and the existence of cookies previously set by the same server. PortaFab only uses web beacons in accordance with applicable laws.
PortaFab or its service providers may use web beacons to track the effectiveness of third-party web sites that provide us with recruiting or marketing services or to gather aggregate visitor statistics and manage cookies.
You have the option to render some web beacons unusable by rejecting their associated cookies. The web beacon may still record an anonymous visit from your IP address, but cookie information will not be recorded.
In some of our newsletters and other communications, we may monitor recipient actions such as email open rates through embedded links within the messages. We collect this information to gauge user interest and to maintain and improve the Online Services.
1.1.6 Location-based Tools
PortaFab may collect and use the geographical location of your computer or mobile device, but only with your express consent. With respect to the collection of precise information about the location of your mobile device, once you have consented to the collection you may adjust this consent by managing your Location Services preferences through the settings of your mobile device. This location data is collected for the purpose of providing you with information regarding services which we believe may be of interest to you based on your geographic location, and to improve our location-based products and services.
1.2 Children
PortaFab understands the importance of protecting children's privacy, especially in an online environment. In particular, our Online Services are not intended for or directed at children under the age of 16. We do not knowingly collect personal data from children under 16. If you are under 16, do not use or provide any information on any of our Services or on or through any of the features/register on the Online Services, make any purchases through the Services, provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal data from a child under 16 without verification of parental consent, we will delete that information. 2. Sharing and transfer of Personal Information
We do not share personal information with unaffiliated third parties, except as stated in this Privacy Policy, including as necessary for our legitimate professional and business needs, to carry out your requests, to market our services, as required or permitted by law or professional standards, or otherwise with your consent.
In some instances, PortaFab may share personal information about you with various third-party service providers and vendors working on our behalf. These third parties include providers of administrative, identity management, website hosting, data analysis, data back-up and security management services. PortaFab requires these entities to safeguard personal information in the same manner as PortaFab and these entities have committed themselves to confidentiality. We may share your personal information with service providers as needed for data privacy or security audits and/or to investigate or respond to a complaint or security threat. PortaFab does not sell personal information to any third parties. Also, PortaFab will not transfer the personal information you provide to any third parties for their own direct marketing use.
PortaFab may also disclose personal information in order to respond to lawful requests of government or law enforcement agencies, including to meet national security or law enforcement requirements or where disclosure is required by applicable laws, court orders, or government regulations. In the event that the ownership of PortaFab or an affiliate or their assets changes as the result of a merger, acquisition, or sale of assets, information owned or controlled by PortaFab may be transferred to another company. Information may also be shared in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, assign or transfer all or a portion of our assets.
PortaFab and our service providers may use personal information in an aggregated, anonymized form for research and development. This data does not identify you individually, but rather helps to identify trends in user preferences and behaviors. In addition, we may share de-identified reports on user demographics and traffic patterns, as well as de-identified information, with third parties.
Cross Border Transfer. PortaFab may transfer certain personal information across geographical borders to our related legal entities or to outside companies working with us or on our behalf. PortaFab may also store personal information in a jurisdiction other than where you are based and such jurisdiction may not provide the same level of protection for your personal information as your home country. Each member firm is required to safeguard personal data in accordance with its contractual obligations and data protection legislation applicable to its provision of services. Your personal data will only be transferred if appropriate or suitable safeguards are in place. When PortaFab transfers personal information to countries other than the country where it was provided, we do so in compliance with applicable data privacy laws and/or regulations, including, as applicable, the European Union General Data Protection Regulation 2016/679 (GDPR), and/or the E.U. Standard Contractual Clauses.
3. Choices
We may require you to provide certain personal information in order for you to receive additional information about our services and events. PortaFab may also ask for your permission for certain uses of your personal information, and you can agree to or decline those uses. If you receive a particular service or communication, such as an e-newsletter, you will be able to unsubscribe at any time by following the instructions included in each communication. If you decide to unsubscribe from a service or communication, we will try to remove your information promptly, although we may require certain information before we can process your request.
As described in "Cookies" section above, if you wish to prevent cookies from tracking you as you navigate our sites, you may be able to do so by changing your browser settings. Note, however, that some portions of the Online Services may not work properly if you elect to refuse cookies.
4. Your Rights
If you have submitted personal information to PortaFab, under most circumstances you have the right to reasonable access to that data to correct any inaccuracies. You can also make a request to update or remove information about you and we will make all reasonable and practical efforts to comply with your request, so long as it is consistent with applicable law and professional standards. Further, when provided by applicable law, you may have additional rights regarding your personal information. For example:
• Individuals located in European Economic Area or the U.K. who provide us with personal information will have (i) the right to access; (ii) the right to rectification; (iii) the right to erasure; (iv) the right to restrict processing; (v) the right to object to processing; (vi) the right to data portability; (vii) the right to withdraw consent and (viii) the right to lodge complaints. 5. Data security and integrity
PortaFab has, and requires its service providers to have, security policies and procedures in place to help protect personal information from unauthorized loss, misuse, alteration, or destruction. Despite PortaFab's efforts, however, security cannot be100% guaranteed against all threats.
We also seek to limit access to your personal information to those who have a need to know. Those individuals who have access to the data are required to maintain the confidentiality of such information. We also make efforts to retain personal information in accordance with the retention periods contained in this Policy and only for so long as the information is needed for our professional, marketing or analytic purposes or to comply with an individual’s request, or until that person asks that the information be deleted.

Please be aware that the Online Services may contain links to other websites, including websites maintained by our related legal entities that are not governed by this Privacy Policy but by other privacy policies that may differ. PortaFab is not responsible for the content or practices of these websites. We encourage users to review the privacy policy of each site visited before disclosing any personal information. Other websites may collect and treat information collected differently.
7. Changes to this Statement
PortaFab may modify this Privacy Policy from time to time to reflect our current privacy practices. When we make changes to this policy, we will revise the "last updated" date at the top of this page. We encourage you to periodically review this Privacy Policy to be informed about how PortaFab is protecting your information. To the extent required by the GDPR, the E.U. Standard Contractual Clauses, or as required by applicable law, PortaFab will contact users whose personal information is within the scope of the GDPR, the E.U. Standard Contractual Clauses, or applicable law and then currently being processed by PortaFab to obtain prior affirmative express consent to any material changes to how we collect, use, process, and/or share such user’s personal information according to this Privacy Policy.
